What is Erb's Palsy?
Erb's Palsy is a birth injury that affects the brachial plexus, a network of nerves located near the neck and shoulder. These nerves control movement and sensation in the shoulder, arm, hand, and fingers.
During a difficult delivery, excessive force or improper medical techniques may stretch, compress, or tear the brachial plexus nerves. When this occurs, a baby may experience weakness, paralysis, or limited mobility in one arm.
The severity of Erb's Palsy can vary significantly. Some children recover fully with therapy, while others experience permanent impairments that affect their daily lives.
Common types of brachial plexus injuries include:
- Stretch injuries (neurapraxia)
- Nerve ruptures
- Nerve avulsions, where the nerve is torn from the spinal cord
- Neuromas, which involve scar tissue around injured nerves
Because Erb's Palsy is often preventable, families may have grounds for a medical malpractice claim when healthcare providers fail to meet accepted standards of care during childbirth.
Common Causes of Erb's Palsy Due to Medical Malpractice
While not every case of Erb's Palsy results from negligence, many occur because medical professionals fail to properly manage complications during labor and delivery.
Several situations increase the risk of brachial plexus injuries, including shoulder dystocia, prolonged labor, and unusually large infants. Healthcare providers are expected to recognize these risks and take appropriate steps to protect both mother and child.
Examples of medical negligence that may lead to Erb's Palsy include:
Failure to Anticipate Shoulder Dystocia
Shoulder dystocia occurs when a baby's shoulder becomes lodged behind the mother's pelvic bone during delivery. This is a medical emergency that requires prompt and careful intervention.
When healthcare providers fail to identify risk factors or respond appropriately, excessive traction on the baby's head or neck can damage the brachial plexus nerves.
Excessive Force During Delivery
One of the most common causes of Erb's Palsy is the improper use of force when attempting to deliver a baby. Pulling too hard on the baby's head, neck, or shoulders can stretch or tear the nerves controlling arm movement.
Improper Use of Delivery Instruments
Forceps and vacuum extractors can be valuable tools during complicated deliveries. However, improper use of these instruments can significantly increase the risk of birth injuries.
Failure to Recommend a Cesarean Section
In some situations, a cesarean section (C-section) may be the safest delivery option. If medical providers fail to recognize signs that a vaginal delivery poses substantial risks, they may be liable for resulting injuries.
Inadequate Monitoring During Labor
Doctors and nurses should closely monitor both mother and baby throughout labor. Failure to recognize complications can delay necessary interventions and increase the likelihood of injury.
Signs of Erb's Palsy
Parents often notice symptoms of Erb's Palsy shortly after birth. Early diagnosis is important because prompt treatment may improve long-term outcomes.
