What is Cerebral Palsy?
Cerebral palsy (CP) is a group of neurological disorders that affect movement, muscle tone, coordination, and posture. The condition results from damage to the developing brain, often occurring before, during, or shortly after birth.
The severity of cerebral palsy varies widely. Some children experience mild mobility limitations, while others may face significant physical and cognitive challenges requiring lifelong assistance.
Common symptoms of cerebral palsy include:
- Muscle stiffness or spasticity
- Poor coordination and balance
- Difficulty walking
- Delayed developmental milestones
- Tremors or involuntary movements
- Speech and communication difficulties
- Problems with swallowing
- Seizures
- Vision or hearing impairments
While cerebral palsy itself is not progressive, the complications associated with the condition can impact a child's health and quality of life for decades.
How Medical Malpractice Causes Cerebral Palsy
Many cases of cerebral palsy are linked to oxygen deprivation or brain injuries that occur during labor and delivery. Healthcare providers have a duty to monitor both mother and baby carefully and respond appropriately when complications arise.
When doctors, nurses, hospitals, or other medical professionals fail to meet accepted standards of care, a preventable birth injury may occur.
Examples of medical negligence that may lead to cerebral palsy include:
Failure to Monitor Fetal Distress
Electronic fetal monitoring can reveal signs that a baby is not receiving adequate oxygen. Ignoring or misinterpreting these warning signs can delay critical medical intervention.
Delayed Cesarean Section
When complications arise during labor, an emergency C-section may be necessary to prevent oxygen deprivation. Unreasonable delays can increase the risk of brain damage.
Improper Use of Delivery Instruments
Forceps and vacuum extractors can cause serious head trauma when used incorrectly, potentially contributing to brain injuries associated with cerebral palsy.
Failure to Treat Maternal Infections
Untreated infections during pregnancy or delivery can affect fetal brain development and increase the risk of neurological damage.
Umbilical Cord Complications
A compressed, prolapsed, or wrapped umbilical cord can reduce oxygen flow to the baby. Medical professionals must identify and address these issues promptly.
Failure to Manage High-Risk Pregnancies
Healthcare providers should closely monitor pregnancies involving conditions such as preeclampsia, gestational diabetes, or placental abnormalities. Negligent management can place both mother and child at risk.
