Statewide inspection data underscores why these standards matter. In May 2024, unannounced inspections of 91 New Mexico long-term care facilities found that 88 percent had at least one violation. Violations of federal or state care standards don’t automatically create civil liability, but they can be powerful evidence of a breach of duty in a negligence claim.
