In a recent out-of-state case, an elderly woman ended up dying while under the care of a nursing home. Thus, a lawsuit has been filed against the nursing home. When a loved one passes away in New Mexico due to nursing home neglect, the surviving loved ones have the right to take legal action in civil court.
The nursing home resident in the out-of-state case had ridden a bus from the nursing home on a Saturday. However, she was not discovered to be missing until the following day. Staff at that time contacted the woman’s family to find out if one of her relatives had come to pick her up. When they were told no, they started searching for the woman, 84, and found her on the bus.
The woman ended up passing away from hyperthermia. The high temperature during the weekend of the incident was around the mid-90s. The daughter of the woman who died on the bus has accused the nursing home of negligent staffing practices, negligence and wrongful death.
In her lawsuit, the woman is suing the corporation that owns the nursing home as well as two employees at the home: the bus driver and the administrator. When an individual passes away due to alleged nursing home neglect, it is within the rights of the surviving family members to file a liability claim against the institution, seeking damages. Once liability is established to the court’s satisfaction in the state of New Mexico, claims for monetary damages will be decided.
