Nursing Home Neglect Blamed For Grandfather’s Death

When New Mexico nursing homes fail to fulfill their responsibility to care for their residents properly and thus cause their residents to die, the deceased residents’ family members have the right to take legal action against the facilities. In one out-of-state case, a man has decided to file a nursing home neglect suit against a nursing facility due to its alleged negligence in caring for his grandfather. His grandfather died while in the nursing home’s care.

According to the lawsuit, the grandfather experienced systemic neglect and abuse while at the nursing home. He reportedly suffered skin breakdown, physical injuries, and many falls. He also is said to have suffered physical pain and suffering, mental anguish and deprivation, or the delay of proper treatment.

The plaintiff asserted that his grandfather’s serious injuries contributed to his death. He is seeking a jury trial and has requested that punitive damages bed imposed. The number of damages will be proven at trial. The plaintiff is also seeking litigation costs.

When a family in New Mexico loses a loved one due to the negligence of a nursing home, the family members may choose to file a nursing home neglect lawsuit against the facility. Compensatory damages may be awarded based upon a showing of negligence; punitive damages could also be awarded in cases of egregious fault. Liability must be established by appropriate proof before a judge will determine claims for monetary damages. Monetary compensation may help to cover medical costs, burial expenses, and other losses linked to the documented incident of nursing home neglect.
