Nursing Home Neglect Suit Filed After Woman Dies

When nursing home staff in New Mexico are negligent in their care, a person may lose his or her life as a result. This is what allegedly happened in a recent out-of-state case. The daughter of a woman who reportedly died after being in the care of a nursing home has decided to file a suit against the home, alleging nursing home neglect.

The daughter said her mother lived at the home for about five months. There, the resident needed help with her daily living activities, which included ambulation and transfers. According to the complaint, the mother suffered a couple of serious falls while she was a resident of the nursing home, allegedly because of staff neglect.

The reported falls caused an open wound to the resident’s head and also resulted in her breaking her hip. The plaintiff said the injuries ended up contributing to her mom’s deterioration, and she eventually died as a result. The daughter is now seeking more than $50,000 in damages in her wrongful death and negligence suit.

Nursing home neglect can unfortunately result in life-changing injuries or cause a person to pass away unexpectedly. In the event of death caused by the neglect of nursing home staff, the surviving loved ones may opt to file a liability suit against the allegedly at-fault nursing facility, seeking damages. If awarded, damages may be used to cover the deceased victim’s funeral expenses and other losses stemming from the reported neglect. Competent proof of negligence is required to establish liability in this type of court case in New Mexico.
