Nursing Home Neglect Suit Settled After Resident Hit By Van

A nursing home in a different state was sued for injuring a resident. The facility recently settled the suit in federal court. When nursing home neglect leads to a resident’s injury in New Mexico or elsewhere, the resident retains the right to pursue claims for financial accountability from the facility.

The recent lawsuit alleged that the nursing home’s van, which a facility employee was driving, struck a resident who was blind. At the time, the resident had reportedly been standing beside a curb waiting to get picked up by someone. According to the lawsuit, the resident fell to the ground after being struck.

Since the incident, the resident has reportedly suffered numbness and pain in his arm. Due to a confidentiality agreement, the lawsuit settlement amount was not released. The nursing home has faced a handful of personal injury and wrongful death lawsuits during the past few years as well. The nursing home has undergone several federal government inspections that have revealed issues with inadequate staffing as well as unsafe building conditions and improper care. Thus, the facility is forced to undergo close monitoring.

If a nursing home fails to exercise a reasonable degree of care regarding patients, it may be held liable for any injuries that occur as a result. Claims for financial damages will be adjudicated by the civil court once liability has been satisfactorily established. A damage award in a nursing home neglect case in New Mexico may help with addressing medical costs and other financial losses — both economic and non-economic — related to the documented incident of neglect.
