The death of a woman in another state has led to a lawsuit. The plaintiff asserted that the nursing facility was responsible since it did not recognize the symptoms and signs of pneumonia. The home is also blamed for generally neglecting its duties to care for the woman while she was being treated at the facility. The plaintiff is seeking judgment in an amount that is sufficient for satisfying the court’s jurisdictional requirements.
People naturally trust nursing homes in New Mexico to properly care for their elderly loved ones, and when they shirk their duties and their patients end up passing away, the deceased victims’ family members have the right to take legal action. Claims for financial damages will be adjudicated in a nursing home neglect case only if and when liability has been satisfactorily established. Monetary compensation cannot reverse the events leading to an elderly family member’s death, but it may make it easier for the victim’s loved ones to move forward from the tragedy.
