Nursing Home Neglect Blamed For The Deaths Of 2 Men

Nursing home neglect in New Mexico can result in serious — and sometimes fatal — injuries to a resident of the facility. Two families in an out-of-state case are suing a healthcare company, alleging wrongful death due to nursing home neglect. The lawsuits were filed after two men passed away in the facility this year.

According to one lawsuit, one convalescent hospital did not adequately care for a resident. The facility is accused of giving the 76-year-old man the incorrect medication. The staff also reportedly allowed ulcers to form on the man’s tailbone, which ultimately caused his death.

In a second suit, a family charged that the nursing facility neglected to properly care for a 69-year-old man. The facility is also accused of committing elder abuse. One law firm represents both families, and an attorney said that the two deaths indicate that the facility has been placing profits over the health of its residents. One victim had been in the nursing home’s care for about two years, while the other one was at the facility for just one month.

Nursing home neglect is a serious problem in New Mexico and across the country.  If a loved one dies due to a nursing facility’s neglect or carelessness, the surviving family members of the victim have the right to file a civil claim for wrongful death against the facility and any individuals whose errors or misconduct led to the fatality. Claims for financial damages will be decided by a civil court once liability is established by appropriate evidence of negligence.
