The death of a nursing home resident in New Mexico can easily occur if the nursing staff breaches the standard of care in these facilities. One woman in a different state recently lost her life due to the alleged negligence of the staff at a nursing home in which she was living. The nursing home and the home’s financial backers have thus been sued for nursing home neglect.
A woman sued the defendants on behalf of the nursing home resident who died. According to the suit, the resident had a medical condition that required her to be specially supervised and assisted in her daily activities. The resident was prone to falling and having accidents, and she was also at risk for developing pressure sores. The woman who filed the suit said the nursing home employees knew about the resident’s condition.
The resident, however, fell twice. Her right femur broke, and she also suffered a pressure sore before she died. The plaintiff has alleged that the defendants were negligent, citing the Nursing Home Care Act. The home is also accused of not providing enough medical or personal care, thus causing mental or physical injuries to an individual.
The woman who filed the suit is seeking damages totaling $50,000. When nursing home staff do not exercise a reasonable degree of care and cause a resident to die, the loved ones of the resident are entitled to file a lawsuit for damages. Financial restitution in a successful case may help to cover burial costs and other expenses tied to the documented incident of nursing home neglect in New Mexico.
