Head Injury Leads To Nursing Home Neglect Claim In Civil Lawsuit

According to multiple media reports, residents of some nursing homes are exposed to a variety of risks. When New Mexico residents are admitted to nursing homes, they– or their loved ones — should have peace of mind and trust that professional care will be provided. Unfortunately, nursing home neglect is often the subject of claims filed in civil courts.

A woman recently filed a claim in another state alleging nursing home neglect. According to the lawsuit, the plaintiff underwent abdominal surgery in another facility and was then transferred to the nursing home. While she was there, a member of the nursing home staff attended to another occupant in the same room. The caregiver apparently bumped into an intravenous pole and knocked it over.

The pole fell onto the plaintiff and caused a head injury to the plaintiff. She claims to have suffered physical and mental pain and suffering, along with anguish and the loss of life enjoyment. The plaintiff contends that such injuries are not common in nursing homes and were brought about by the negligence of the staff member.

Nursing home neglect can cause severe personal injury and even death to residents who are receiving care according to accepted standards. The victims of abuse and neglect in New Mexico care facilities are entitled to pursue compensation for medical expenses or end-of-life costs when applicable. Personal injury and wrongful death claims require sufficient evidence of neglect and, for the successful presentation of such claims, the guidance of attorneys who focus on nursing home neglect may be beneficial.
