Nursing Home Neglect Suit Filed After Woman Suffers Injuries

Nursing homes in the state of New Mexico sometimes do not meet their obligations to properly care for their residents, and, unfortunately, residents can suffer injuries as a result. In one out-of-state case, a nursing home reportedly had issues, such as understaffing, that led to the neglect of and injuries to one female resident. A nursing home neglect lawsuit has since been filed against the facility.

According to the lawsuit, the nursing home did not provide the woman with her basic needs while she was a resident there. This included bathing, providing water and food, and helping with activities. The facility is also accused of not providing adequate security for the building.

Due to the alleged neglect, the resident suffered many falls. The falls are said to have caused the woman to suffer a leg fracture, and her overall mental and physical conditions significantly deteriorated. The lawsuit filed against the nursing facility alleges reckless misconduct, along with negligence.

As part of the lawsuit, the plaintiffs are seeking a jury trial, along with compensatory and punitive damages. Punitive damages are awarded in cases of egregious fault. The reimbursement of litigation expenses is also being sought as part of the nursing home neglect legal claim. When a person’s loved one is hurt due to the carelessness of a nursing home, he or she has the right to seek to hold that nursing home accountable through the civil court system. Damages will be awarded in such a case only if and when liability is satisfactorily established in a New Mexico civil court.
