Widow Files Nursing Home Neglect Claim Against Care Facility

A woman has filed a claim against a nursing home relating to the neglect of her deceased husband, who was a resident at the facility. Her complaint states that the nursing home and rehabilitation center is liable for wrongful death. Her lawsuit alleges instances of nursing home neglect, negligence, and other violations. Although this case occurred out of state, numerous instances of similar neglect and abuse, unfortunately, occur in New Mexico nursing facilities, too.

The lawsuit says that the deceased man had been living at the nursing home from late 2010 through early 2013. While living at the home, he was allegedly victimized by neglect that led to skin breakdown. Court papers say that the nursing home did not try to prevent the skin breakdown and then they failed to treat it, which played a significant role in the man’s death.

The lawsuit cites negligence, ordinary negligence, statutory violations, wrongful death, and reckless misconduct. The man’s wife is asking for an unspecified amount of damages. She is also asking for attorney’s fees.

Whenever a New Mexico resident suspects that his or her loved one is suffering from nursing home neglect, it is vital that the individual take action to ensure that the nursing home resident is getting the immediate medical attention required. Next, family members may wish to look into the possibility of pursuing a civil claim for damages. If successfully navigated, such a claim could be a way for nursing home neglect victims to seek financial restitution to pay for the medical care they require to recover from their injuries.
