Nursing homes in New Mexico do not always exercise care when tending to patients, which may unfortunately lead to a resident’s death. One woman in another state has died due to alleged nursing home neglect. Her death has sparked a lawsuit filed against the nursing and rehab facility responsible for her care.
The independent administrator for the deceased woman’s estate recently filed a civil suit against the center, alleging negligence. According to the suit, the woman developed pressure sores at the center, or her sores worsened while she was there. In addition to suffering from these sores on her lower extremities, the woman suffered infections in a sacral wound.
The woman is also believed to have suffered from severe respiratory distress, MRSA, sepsis, and pneumonia, which hastened her death. The center’s staff are blamed for not properly monitoring and supervising the woman and for not notifying the woman’s doctor of her condition when it became worse. The facility is also accused of not providing appropriate care in compliance with the state’s nursing home care act.
As part of the suit, the independent administrator is seeking a jury trial along with more than $50,000 in damages. If nursing home staff in New Mexico do not properly take care of their patients, who are typically elderly and thus naturally vulnerable, they may be held liable through the civil court system. The surviving loved ones of residents who died due to nursing home neglect have the right to seek damages. Financial restitution from a case that is fought victoriously may help to cover burial expenses and other expenses tied to a document neglect incident.
