A woman in a different state recently claimed that a nursing home caused her husband’s death. She filed a lawsuit against the home, alleging that the facility failed to create an environment that would prevent accidents. Individuals who lose loved ones due to nursing home neglect in the United States, including in New Mexico, have the right to explore their legal options in an effort to right any wrong that was committed.
According to the complaint of the widow, her husband resided at the nursing home between 2014 and 2015. While there, he reportedly fell accidentally multiple times. The woman also asserted that he suffered neglect, abuse and physical pain, along with mental anguish and medical expenses.
The woman claimed that the man’s suffering from his neglect and abuse was a contributing factor in his August 2015 death. She alleged that the nursing facility did not adequately supervise the man. It is also blamed for not providing the necessary assistance devices for preventing accidents and for not providing a proper resident care plan.
As part of the woman’s nursing home neglect lawsuit, she is seeking a jury trial along with damages, lawyer fees and costs. It is within the rights of any person in New Mexico who has lost a loved one due to the negligence of a nursing home to file a liability claim, seeking reimbursement of monetary damages. Although compensation cannot reverse the events that led to the loved one’s death, it may help the surviving family members to experience a sense of justice and closure in the situation.
