Nursing home neglect suits filed against facility after 2 deaths

Nursing homes in New Mexico are naturally trusted to properly take care of the residents they receive. In some cases, however, nursing homes end up doing the opposite, thus causing injuries to or the deaths of residents. Two nursing home neglect lawsuits were recently filed against one nursing home in another state.

In the first case, a woman was placed inside a nursing home at age 69. According to a complaint, the woman ended up suffering falls and fractures while she was there. She is said to have eventually died due to the emotional and physical trauma she suffered while at the nursing facility.

In the second case, a woman reportedly suffered sepsis, infections, pressure sores and pneumonia while at the nursing home. The plaintiff in this case alleged the woman ultimately died due to the nursing home's actions. The plaintiffs in the two cases, both of them the daughters of the alleged victims, claimed that the nursing home knew about staffing problems and the dangerous environment there stemming from its poor control and management methods.

When New Mexico nursing homes fail to care for their residents in a reasonable way, they may be held liable for any deaths or injuries that occur as a result. A person who is hurt at a nursing home is entitled to file a liability claim against the home, seeking damages. Likewise, the surviving loved ones of a resident who dies at the home has the right to file a wrongful death claim. If liability is established to the satisfaction of the civil court hearing the case, claims for financial damages will be determined. A monetary award may help to pay for burial costs, medical expenses and other losses tied to a documented nursing home neglect incident.
